using the foreign equivalent of the term for “Jewelry Store” for
jewelry store services makes the mark unregistrable as “merely
descriptive.” The client should add additional wording or a design
element to the mark.

4. Access the USPTO website and use the New User search form. Locate the
registration for CHILI-O. When was the mark registered?
The mark was registered on Sept. 20, 2011.

5. Access the USPTO website and use the New User search form. Locate the mark
registered as U.S. Reg. No. 3648804.

The mark is KANYE WEST.

b. Access TSDR. Review the outgoing Office Action dated May 16, 2005.
Briefly, what reasons did the USPTO give for initially refusing

Three reasons were given for refusing registration: The
recitation of services needed clarification; the applicant was

application was not signed.
