Putting It into Practice
1. By the time a case reaches the Supreme Court, there has been extensive litigation in trial and appellate courts. Before parties file lawsuits, they usually try to resolve their disputes informally. Assume that you work for the state of Massachusetts in the case of Massachusetts v. E.P.A. described in the chapter. Draft a letter to be sent to the E.P.A. requesting that it enforce the provisions of the Clean Air Act relating to pollutants emitted by motor vehicles. Before writing the letter, search the Internet for some general information regarding the harmful effects of various motor vehicle emissions. Also search the Internet for some general information about the Clean Air Act. Use relevant information in your letter.
Student answers will vary, but their letters may include the following points:
Harmful effects of various motor vehicle emissions: Illnesses that are exacerbated by air pollution include cardiovascular disease, asthma or chronic obstructive pulmonary disease, potential damage to the ozone layer, and possible negative effects on the natural environment.
Clean Air Act: The benefits and costs associated with the Clean Air Act (benefits outweighing the costs), and healthier living that would save on medical expenses for air pollution-related health problems.
