4. Review the Economic Espionage Act. Assume that ABC Inc., a German
company, stole a trade secret from Microsoft, which was worth $1 million. What
fine may be imposed on ABC?
ABC shall be fined not more than the greater of $10 million or three
times the value of the stolen trade secret to the organization, including
expenses for research and design and other costs of reproducing the
trade secret that the organization has thereby avoided. Thus, ABC
may be fined $10 million or $3 million (including research and design
costs), whichever is less.
