Constitutional Law
Chapter 5 -
Part 4
Putting It Into Practice
1. Using any general Internet search engine, find an application for a presidential pardon for use after an individual has completed his or her sentence. Read the complete form. Assume that you will be interviewing a client who wishes to apply for a pardon. Draft a questionnaire you could use in the interview to obtain relevant information.
Answers will vary, but students may include questions that are similar to the following examples:
1) Have you satisfied the minimum five-year waiting period for eligibility?
2) Are you willing to accept responsibility for the crime?
3) Have you established good conduct since you have been convicted?
4) Is this your first federal conviction? If not, how many have you had?
5) Do you have any delinquent credit obligations?
6) Are you currently, or have you ever been, a party in a civil lawsuit?
7) Do you have at least three people, not related by blood or marriage, willing to submit a character affidavit on your behalf?
