Plaintiffs are individuals and citizens of the United States who reside within the jurisdiction of this Court. Plaintiffs' claim to citizenship arises under 8 U.S.C. § 1401(g). All claims arise from a similar set of circumstances.2. William French Smith, the Defendant herein, is the Attorney General of the United States of America and is sued herein in his official capacity. Defendant is responsible for the issuance of certificates of citizenship pursuant to 8 U.S.C. § 1452.3. The Court has jurisdiction of this action pursuant to 8 U.S.C. § 1503(a) and § 28 U.S.C. § 2201.4. On or about June 10, 1982, Plaintiffs applied for certificates of citizenship.5. On or about February 10, 1984, Defendant denied Plaintiffs' application.6. Plaintiffs have exhausted their administrative remedies.7. Defendant's refusal to issue Plaintiffs certificates of citizenship was arbitrary and not in accordance with law.8. Defendant has denied Plaintiffs' claims as set out above and, on his part, contends that Plaintiffs are not citizens of the United States.9. Plaintiffs desire a judicial determination of their rights and duties and a declaration that they are citizens of the United States.WHEREFORE, Plaintiffs pray that:1. The Court render a declaratory judgment that the Plaintiffs are citizens of the United States and are entitled to all of the rights and privileges of citizens of the United States including the right to possess certificates of citizenship.2.
